🎓 Apprentices Guide

Apprentices' Rights in Northern Ireland

ApprenticeshipsNI and Higher Level Apprenticeships, the apprentice rate, paid training time, holiday and sick pay, and what to do if it goes wrong.

📅 Last reviewed: 23 October 2026 📚 Sources: listed at the end, each checked on the date shown Northern Ireland

Who this guide is for

Apprentices working in Northern Ireland on ApprenticeshipsNI (levels 2 and 3) or a Higher Level Apprenticeship (levels 4 to 7), and people thinking of starting one.

What this guide does not cover

⚖ At a glance

  • You are an employee of a Northern Ireland-based employer (or a UK company with operations in Northern Ireland), paid just as any other employee.
  • To join, you must be at least school leaving age (16), and starting paid work in Northern Ireland or employed by your current employer for less than six months.
  • You must work at least 21 hours a week on a permanent contract.
  • ApprenticeshipsNI apprentices get at least the apprentice rate: £8.00 an hour from 1 April 2026 if under 19, or 19 or over and in the first year.
  • Your employer must pay you for directed training. It counts as part of your contracted hours.
  • Claims go to an industrial tribunal. You notify the LRA first, not Acas.

What the rules depend on

  1. Are you on ApprenticeshipsNI or a Higher Level Apprenticeship? The apprentice rate does not apply to Higher Level Apprenticeships.
  2. How old are you, and how long have you been on the apprenticeship? That decides your minimum pay.
  3. What does your contract say about ending it early?
  4. When did your employment end, or the problem happen? That date decides your time limit.

"How do apprenticeships work in Northern Ireland?"

The Department for the Economy runs two programmes:

Both take at least two years, and some take longer. On ApprenticeshipsNI you usually spend four days a week with your employer and one day with your training provider. On a Higher Level Apprenticeship the pattern depends on your employer. You, your employer and your training provider agree a Personal Training Plan.

The rules for apprenticeship agreements in the Apprenticeships, Skills, Children and Learning Act 2009 do not apply in Northern Ireland.

"What will I be paid?"

You must be paid at least the National Minimum Wage. The rates are the same as in the rest of the UK. ApprenticeshipsNI counts as an apprenticeship for the apprentice rate. From 1 April 2026:

The Department for the Economy says the apprentice rate does not apply to Higher Level Apprenticeships. On one of those, you get at least the minimum wage for your age.

Your employer must pay your hourly rate for directed training, which counts as part of your contracted hours.

"Do I get holiday and sick pay?"

Yes. Your employer pays you just as it would any other employee. The statutory minimum holiday is 5.6 weeks a year: 28 days if you work 5 days a week.

Since 6 April 2026, statutory sick pay is paid from the first full day of sickness absence, with no minimum earnings, as in the rest of the UK.

If you are under 18, your working time must not go over 8 hours a day or 40 hours a week.

"Can my apprenticeship be ended early?"

This guide does not set out when an apprenticeship contract in Northern Ireland can be ended early. It depends on what your contract says. Ask the LRA.

Unfair dismissal needs at least 1 year of continuous employment. Some dismissals need no minimum service. For the rest of your rights, see Your Rights as an Employee in Northern Ireland.
