How Do I Appeal a Parking Ticket in Northern Ireland?

Who this guide is for

People in Northern Ireland who have a parking ticket and want to know whether to pay it or challenge it. It covers a Penalty Charge Notice (PCN) processed by the Department for Infrastructure (DfI), a ticket from a council car park, and a Parking Charge Notice from a private parking company.

• A DfI parking ticket (PCN) is £90. If you pay within 14 days, a 50% discount applies and you pay £45 (nidirect).
• If it is not paid within 28 days, a Notice to Owner is sent to the registered keeper. After that you have 28 days to pay, or a Charge Certificate raises the amount to £135.
• Challenges must be in writing, online or to the Parking Enforcement Processing Unit. If you challenge within 14 days, the discount period does not end while your challenge is looked at.
• If your representations are rejected, you can appeal to the Northern Ireland Traffic Penalty Tribunal, which is independent. Its decision binds both you and DfI.
• A private Parking Charge Notice is not a PCN. The keeper rules in the Protection of Freedoms Act 2012 apply only in England and Wales.

The questions that decide the answer

• Who issued it? A PCN processed by DfI: the steps below apply. A council car park ticket: follow the instructions on it. A private company's Parking Charge Notice: see the private section. The police: not covered here.
• Did you get the original PCN? If you only received a Notice to Owner, the £45 discount is not available, because it only applies for 14 days from the date of the PCN.
• What stage is it at? PCN, Notice to Owner, Notice of Rejection of Representations, or Charge Certificate.
• Private ticket: were you the driver, or only the registered keeper? This guide does not cover whether the keeper can be made to pay in Northern Ireland: ask Advice NI or a solicitor.

Department for Infrastructure tickets

• Under the Traffic Management (NI) Order 2005, DfI is responsible for enforcing parking rules. All DfI parking tickets are processed by its Parking Enforcement Processing Unit, and all letters about a ticket should go there.
• The PCN is £90. If you pay within 14 days, a 50% discount applies and you pay £45.
• If the PCN is not paid within 28 days, a Notice to Owner is sent to the registered keeper. Once a Notice to Owner has been issued, the PCN must be paid within 28 days or a Charge Certificate is issued, which raises the amount from £90 to £135.
• If you received a Notice to Owner asking you to pay £90 but never got a PCN, the £45 discount is not available.
• Challenging: a challenge must be in writing, online or by letter to the Parking Enforcement Processing Unit. If it is received within 14 days, the discount period does not end while it is considered; if the PCN is upheld, the reply gives you a new discount deadline. If your challenge arrives after the discount period, the full charge applies if the PCN is upheld. If the challenge succeeds, the PCN is cancelled and you are told in writing.
• Appeal to the tribunal: the Northern Ireland Traffic Penalty Tribunal can only become involved once you have made representations to the Parking Enforcement Processing Unit. If they are rejected, you are sent a Notice of Rejection of Representations with a Notice of Appeal to the Tribunal and a guidance leaflet. The appeal is decided by an adjudicator, a qualified solicitor or barrister, and the decision is binding on you and on DfI. The time limit for appealing is on the notice.
• If you do not pay: the amount is pursued through debt recovery. This can be through the Enforcement of Judgments Office and may include clamping and removal of the vehicle, with any extra fees and costs added.

Council car parks

• The Consumer Council says that since 1 April 2024 council-owned car parks are managed by a private parking operator instead of DfI, that the attendants' legal authority has not changed, and that PCNs issued there are valid and must be paid or appealed by following the instructions on the notice.

Private parking charges

• A Parking Charge Notice is issued by a private car parking company when the terms and conditions of a private car park are broken. The Consumer Council says it is different from a Penalty Charge Notice.
• Appeal to the company first, using the details on the notice. POPLA hears appeals about tickets from British Parking Association members in Northern Ireland, after the company has rejected your appeal and given you a verification code. POPLA is free. For other companies, check their rejection letter for the appeals service they use.
• Schedule 4 of the Protection of Freedoms Act 2012, which lets a parking company make the registered keeper pay, applies only in England and Wales.
• If the company takes you to court for £5,000 or less, the claim goes to the small claims court. See the small claims guide.

• DfI PCN: pay within 14 days for the discount; a Notice to Owner follows if it is not paid within 28 days.
• Notice to Owner: pay within 28 days, or a Charge Certificate is issued.
