Office holder status, whistleblowing, the LRA and complaints to the Police Ombudsman.
Describe what has happened. The checker answers only from this guide, plus what you tell it, and says so if something is not covered.
Check My Rights →Police officers in Northern Ireland, such as officers of the Police Service of Northern Ireland (PSNI). It also covers members of the public who want to complain about the police in Northern Ireland.
No. The Equality Act 2010 does not apply in Northern Ireland. Discrimination at work is covered by Northern Ireland's own equality laws. This guide does not set out how they apply to police officers: ask the Equality Commission for Northern Ireland. Claims of discrimination because of religious belief or political opinion go to the Fair Employment Tribunal; other claims go to an industrial tribunal.
Not ordinary unfair dismissal. The Employment Rights (Northern Ireland) Order 1996 does not give people in police service the ordinary right not to be unfairly dismissed. The exceptions include a dismissal because you made a protected disclosure (whistleblowing). For any other exception, ask the LRA.
Since 15 December 2004, for whistleblowing law, a person who holds the office of constable in Northern Ireland is treated as an employee employed by the Chief Constable. You are protected from being treated badly (detriment), and from dismissal, because you made a protected disclosure. For what counts, use the whistleblowing checker.
Before most claims you must notify the Labour Relations Agency (LRA). Early conciliation through the LRA is free. If you notify the LRA within your time limit, the clock stops for up to 1 calendar month while conciliation takes place, plus up to 14 more days if both sides agree.
A misconduct case against you and your own claim are separate. Being under investigation does not stop you bringing your own claim.
Complaints about the Police Service of Northern Ireland, and some other police in Northern Ireland, go to the Office of the Police Ombudsman for Northern Ireland. You must complain within one year of the incident. The Police Ombudsman can decide to look at an older complaint if it is grave or exceptional.
